Limitation of Liability

To the fullest extent permitted by applicable law:

‍No Indirect Damages
Digital Quantum LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunities, loss of data, loss of goodwill, or business interruption, even if Digital Quantum LLC has been advised of the possibility of such damages.

‍Maximum Liability Cap
In no event shall the total aggregate liability of Digital Quantum LLC, whether in contract, tort (including negligence), strict liability, or otherwise, exceed the total amount actually paid by the client to Digital Quantum LLC during the three (3) months immediately preceding the event giving rise to the claim.

‍Single Claim Basis
The limitation of liability applies per claim and in aggregate, regardless of the number of claims, actions, or proceedings.

‍Third-Party Platforms Disclaimer
Digital Quantum LLC shall not be held liable for any damages, losses, or consequences resulting from actions, decisions, suspensions, policy changes, algorithm updates, outages, or restrictions imposed by third-party platforms, including but not limited to Google, Meta, LinkedIn, TikTok, or any advertising, analytics, or hosting provider.

‍Client Decisions and Use of Services
The client acknowledges that all strategic, marketing, and business decisions remain under the sole responsibility of the client. Digital Quantum LLC shall not be liable for the outcomes resulting from the client’s implementation, interpretation, or use of the services provided.

‍Force Majeure and External Factors
Digital Quantum LLC shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to force majeure events, regulatory changes, technical failures, platform outages, or market conditions.

‍Essential Basis of the Agreement
The client expressly acknowledges that the limitations of liability set forth in this section constitute an essential basis of the agreement between the parties and that the fees charged reflect the allocation of risk described herein.
